Sierra Valley Almonds files suit for allegedly unpaid shipment of nuts

FRESNO – A Madera County nut seller alleges it was not paid in full for a shipment of almonds.

Sierra Valley Almonds LLC filed a complaint on June 22 in the U.S. District Court for the Eastern District of California, Fresno Division against R&J Almonds Inc., doing business as Jonny Almond Nut Co., alleging that the Michigan corporation failed to make a full payment for the total balance due to plaintiff.

According to the complaint, the plaintiff alleges that Sierra Valley Almonds LLC suffered damages to its business as a result of an unpaid balance for the products it has delivered to the defendant in January. The plaintiff holds R&J Almonds Inc. responsible because the defendant allegedly made a partial payment but failed and refused to pay the total balance owed to plaintiff.

The plaintiff seeks compensatory damages of $119,400 plus interest, all legal fees and any other relief as this court deems just. It is represented by David M. Gilmore of Gilmore Magness Leifer in Fresno.
