SAN FRANCISCO – A San Francisco man alleges his insurance company did not cover his medical treatment.
Robert Macintosh filed a complaint on June 22 in the U.S. District Court for the Northern District of California against UnitedHealthcare Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2015, he underwent several surgeries due to multiple medical conditions and that all claims regarding his treatment were denied by the defendant. The plaintiff holds UnitedHealthcare Insurance Co. responsible because the defendant allegedly denied plaintiff's claim for coverage of acute inpatient rehabilitation deeming that it wasn't medically necessary, and also denied coverage of other medical treatment.
The plaintiff seeks payment of all plan benefits to plaintiff, all damages, all legal fees, interest and any other relief as the court deems just. He is represented by Terrence J. Coleman and Michael J. Quirk of Pillsbury & Coleman LLP in San Francisco.
