SACRAMENTO – The owner of a Merced retail store has filed a suit against the federal government alleging that the government permanently disqualified it from participating in the Supplemental Nutrition Assistance Program.
Fathi Eltareb and El Tareb Market No. 2 filed a complaint on June 23 in the U.S. District Court for the Eastern District of California against United States of America, requesting a judicial review.
According to the complaint, the plaintiffs allege that they suffered damages to their business as a result of being permanently disqualified from SNAP by the U.S. Department of Agriculture through the Food & Nutrition Service on Feb. 16, 2015. The plaintiffs hold United States of America responsible because the defendant allegedly upheld its decision in permanently disqualifying plaintiffs from SNAP despite the plaintiffs filing an administrative review that presents arguments and evidence to support their claim.
The plaintiffs seek request for judicial review, judgment against the defendant for allegedly improperly permanently disqualifying them and all legal fees. They are represented by Gary J. Coelho II of Frame, Matsumoto, Coelho LLP in Fresno.
