SAN FRANCISCO – A San Francisco coconut water distributor alleges that a New York business made the packaging of its product highly similar to plaintiff's product packaging.
Harmless Harvest Corp. Inc. filed a complaint on June 23 in the U.S. District Court for the Northern District of California against All Market Inc., doing business as Vita Coco, alleging trade dress infringement.
According to the complaint, the plaintiff alleges that its product packaging was copied by the defendant, causing confusion among the consumers and purportedly damaged its business. The plaintiff holds All Market Inc. responsible because the defendant allegedly discarded its previous design package and went with a design that closely resembles plaintiff's packaging.
The plaintiff requests a trial by jury and seeks to permanently enjoin the defendant from further infringing plaintiff's packaging design, order for the defendant to submit all infringing physical items that infringe plaintiff's trade dress for destruction, damages, monetary gains from the allegedly unlawful acts, enhanced damages, punitive and exemplary damages, interest, all legal fees and any other relief as this court deems just.
