SACRAMENTO – A consumer alleges that the manufacturers of pelvic mesh products produced defective devices.
Caroline Matarazzo filed a complaint on June 27 in the U.S. District Court for the Eastern District of California against American Medical Systems Inc. American Medical Systems Holdings Inc.; Endo Pharmaceuticals Inc.; Endo Pharmaceuticals Holdings Inc.; Endo Health Solutions Inc.; and Does 1 through 200 alleging strict products liability, negligence and other counts.
According to the complaint, the plaintiff alleges that she suffered physical pain including bleeding, infections and painful sexual intercourse as a result of placement of the defendants' defective sling device. The plaintiff holds the defendants responsible because the defendants allegedly manufactured the defective Sling and distributed them to consumers with the knowledge that their product could cause injuries and prematurely fail. The suit states the defendants failed to disclose this information to consumers.
The plaintiff requests a trial by jury and seeks special and general damages, all medical expenses, punitive damages, loss of earning capacity, interest, all legal fees and any other relief as the court deems just.
