SAN FRANCISCO – A San Luis Obispo resident has filed a lawsuit against three auto manufacturers alleging that they violated U.S. environmental law by putting a "defeat device" in its cars to pass emissions tests.
Armin Bandari filed a complaint on June 29 in the U.S. District Court for the Northern District of California against Audi Aktiengesellschaft, Audi of America Inc. and Audi of America LLC alleging breach of contract, breach of implied warranty and other counts.
According to the complaint, the plaintiff alleges that on July 27, 2015, he purchased a 2015 diesel Audi Quattro A7 that contained a defeat device. The plaintiff holds Audi Aktiengesellschaft, Audi of America Inc. and Audi of America LLC responsible because the defendants allegedly knowingly manufactured vehicles that contain a defeat device and sold them to consumers.
The plaintiff requests a trial by jury and seeks actual damages, restitution, punitive damages, consequential and incidental damages, all legal fees and any other relief as the court deems just. He is represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
