SACRAMENTO – Two city of Vallejo employees allege they were underpaid for overtime work and have filed a class-action lawsuit.
Mat Mustard and Benjamin Hill filed a complaint on behalf of all similarly situated individuals on June 30 in the U.S. District Court for the Eastern District of California against the city of Vallejo alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours but were not paid any overtime wages by the defendant. The plaintiffs hold the city of Vallejo responsible because the defendant allegedly failed to pay overtime compensation at a rate of time-and-one-half to the plaintiffs for all hours worked in excess of 40 per workweek.
The plaintiffs seek unpaid overtime wages plus interest, liquidated damages, all legal fees and any other relief as the court deems just. They are represented by David E. Mastagni, Isaac S. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
