Uncle Bubble files patent suit over bubble wand

Patents 09

SAN FRANCISCO – A San Jose toy maker alleges that another business has copied the design of a bubble wand.

D Now Inc., doing business as Uncle Bubble, filed a complaint on July 6 in the U.S. District Court for the Northern District of California against TPF Toys Limited and TPF Toys LLC alleging patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of a toy similar to its patented Bubble Blower Tube being manufactured by the defendants. The plaintiff holds TPF Toys Limited and TPF Toys LLC responsible because the defendants allegedly used plaintiff's patented designs in their products and sold them to consumers.

The plaintiff requests a trial by jury and seeks to enjoin the defendants from further infringing its patents, for the defendants to pay plaintiff all damages and monetary relief, interest, all legal fees and any other relief as the court deems just. It is represented by Otto O. Lee, Kevin Viau and Bonnie J. Wolf of Intellectual Property Law Group LLP in San Jose.
