Dean River Productions Inc. accused of not paying employee contributions

LOS ANGELES – Several trust funds allege an employer did not pay contributions on behalf of its employees.

Board of directors of the Motion Picture Industry Pension Plan; board of directors of the Motion Picture Industry Individual Account Plan, and the board of directors of the Motion Picture Industry Health Plan filed a complaint on July 6 in the U.S. District Court for the Central District of California, Western Division against Dean River Productions Inc. alleging violation of the Employee Income Retirement Security Act.

According to the complaint, the plaintiffs allege that they sustained damages as the result of unpaid contributions by the defendant from the period of Sept. 4, 2005, to Aug. 31, 2009. The plaintiffs hold Dean River Productions Inc. responsible because the defendant allegedly failed to pay plaintiff for monthly contributions on behalf of its employees.

The plaintiffs seek unpaid contributions in the sum of $4,021 plus interest on all delinquent contributions, liquidated damages, audit cost of $2,565, all legal fees and any other relief as the court deems just. They are represented by Kathryn J. Halford, Elizabeth Rosenfeld and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino.
