Suit filed against companies over alleged infringement of fabric design

LOS ANGELES – A Vernon company alleges that two companies sold a design of fabric that is similar to its copyright design.

Matrix International Textile Inc. filed a complaint on July 8 in the U.S. District Court for the Central District of California against Ross Stores Inc., individually and doing business as DD's Discounts; Touch Me Fashion Inc., individually and doing business as Teenbell; and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its copyrighted designs being infringed by the defendants. The plaintiff holds Ross Stores Inc., Touch Me Fashion Inc. and Does 1 through 10 responsible because the defendants allegedly distributed fabrics to retailers that bear print designs that are relatively similar to plaintiff's designs.

The plaintiff requests a trial by jury and seeks enjoin the defendant, award plaintiff all profits and statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by Stephen M. Doniger, Scott A. Burroughs and Frank Gregory Casella of Doniger/Burroughs in Venice.
