Earthlink Inc. accused of making unauthorized charges to account

SACRAMENTO – A Placer County consumer has filed a class-action lawsuit against an internet provider alleging it unlawfully charged her account.

Linda Kleiner filed a complaint on behalf of all others similarly situated on July 13 in the U.S. District Court for the Eastern District of California against Earthlink Inc. alleging violation of the Electronic Funds Transfer Act.

According to the complaint, the plaintiff alleges that in December 2015, she contacted the defendant to inquire about purchasing its internet services. The suit states that the services were not what she was wanting, so she canceled the transaction. The plaintiff holds Earthlink Inc. responsible because the defendant allegedly automatically enrolled plaintiff for reoccurring charges on her banking account for a service she did not purchase in the first place.

The plaintiff requests a trial by jury and seeks statutory damages of $1,000 per class member, actual damages, interest, all legal fees and any other relief as the court deems just. She is represented by Todd M. Friedman and Adrian R. Bacon of Law Offices of Todd M. Friedman PC in Beverly Hills.
