Woman files suit seeking reinstatement of disability benefits from LINA

Insurance 06

LOS ANGELES – A Lompoc woman who alleges she is disabled because of chronic back pain alleges her disability benefits were wrongfully terminated.

Carla Pohlman filed a complaint on July 13 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on Aug. 5, 2014, her disability benefits were approved by the defendant but later was terminated on May 1, 2015. The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly upheld its decision to deny disability benefits to plaintiff despite having sufficient medical records to support her claim.

The plaintiff seeks declaratory judgment against the defendant requiring it to pay plaintiff long-term disability benefits plus interest, all legal fees and any other relief as the court deems just. She is represented by Robert J. Rosati of ERISA Law Group LLP in Fresno.
