Man accuses LINA of wrongfully terminating benefits

LOS ANGELES – A man alleges his disability benefits were wrongfully terminated.

Dennis Davis filed a complaint on July 14 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in January 2015, he became disabled and was initially being paid disability benefits by the defendant until it was terminated on Sept. 22, 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny further disability benefits to plaintiff based on the opinions of financially biased physicians.

The plaintiff seeks award all benefits due to plaintiff plus interest, determine that plaintiff is entitled to future disability benefits, all legal fees and any other relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
