SACRAMENTO – A Bakersfield woman alleges she purchased a car that had a defective transmission.
McKayla Hollins filed a complaint on July 15 in the U.S. District Court for the Eastern District of California against Ford Motor Co. and Carmax Auto Superstore California LLC alleging violation of the Magnuson Moss Warranty Act and other counts.
According to the complaint, the plaintiff alleges that in 2015, she purchased a Ford Fiesta that had a defective transmission system from Carmax Auto Superstore. The plaintiff holds Ford Motor Co., Carmax Auto Superstore California LLC and Does 1-30 responsible because the defendants allegedly failed to properly educate sales staff regarding the nature of the Dual Powershift 6-speed transmission and claimed that that car had been inspected.
The plaintiff requests a trial by jury and seeks general damages, incidental and consequential damages, restitution and rescission of purchase agreement, punitive and statutory damages, interest, all legal fees and any other relief as the court deems just.
