The Revolver Film Co. U.S.A. accused of not paying contributions

Contract 06

LOS ANGELES – Several labor union funds allege an employer failed to pay contributions for almost four years.

Board of directors of the Motion Picture Industry Pension Plan, board of directors of the Motion Picture Industry Individual Account Plan and the board of directors of the Motion Picture Industry Health Plan filed a complaint on July 18 in the U.S. District Court for the Central District of California, Western Division against The Revolver Film Co. U.S.A. Limited alleging that breach of contract.

According to the complaint, the plaintiffs allege that they sustained damages due to unpaid contributions. The plaintiffs hold The Revolver Film Co. U.S.A. Limited responsible because the defendant allegedly failed to pay its monthly contributions on behalf of its employees according to their agreement with the plaintiffs. The suit states the defendant did not pay contributions from Jan. 4, 2004, to April 5, 2008, as discovered by an audit.

The plaintiffs seek unpaid contributions of $12,066.19 plus interest rate of 1 percent per month, liquidated damages, audit costs of $6,255, all legal fees and any other relief as this court deems just. They are represented by Kathryn J. Halford, Elizabeth Rosenfeld and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino.
