SAN FRANCISCO – A Utah company and its insurer have filed a suit against a transport company alleging it failed to deliver a shipment.
Goal Zero LLC and Falvey Cargo Underwriting LTD filed a complaint on July 19 in the U.S. District Court for the Northern District of California against Cargo Freight Services LTD, Cargo Freight Services LTD and Does 1 through 10 alleging breach of contract.
According to the complaint, the plaintiffs allege that Goal Zero LLC, Falvey Cargo Underwriting LTD suffered damages as the result of their cargo of solar energy equipment not being delievered by the defendants in 2013. The plaintiffs hold Cargo Freight Services LTD and Cargo Freight Services LTD and Does 1 through 10 responsible because the defendants allegedly failed to deliver 126 cartons from Hong Kong, China to Rotterdam, Netherlands.
The plaintiffs seek pay plaintiff in the amount of $95,183.55 for damaged shipment plus interest, all legal fees and any other relief as the court deems just. They are represented by Jennifer T. Sanchez of Gibson Robb & Lindh LLP in San Francisco.
