Motion Picture Industry funds file suit against IM Global, Moot Point Secret

LOS ANGELES – The boards of directors of labor union funds have filed a suit seeking an audit to determine if contributions were paid.

Board of directors of the Motion Picture Industry Pension Plan, board of directors of the Motion Picture Industry Individual Account Plan, board of directors of the Motion Picture Industry Health Plan filed a complaint on July 19 in the U.S. District Court for the Central District of California, Western Division against the Moot Point Secret Inc., IM Global LLC, also known as IM Productions LLC, alleging violation of the Employee Retirement Income Security Act and breach of contract.

According to the complaint, the plaintiffs are seeking records for an audit to determine if the defendants have paid contributions on behalf of its employees. The plaintiffs holds Moot Point Secret Inc., IM Global LLC, IM Productions LLC responsible because the defendants allegedly failed to provide accurate reports and contributions to the labor groups on behalf of their employees for work done in January 2015 on the production "The Secret in their Eyes."

The plaintiffs seek make available to the plans all records for the defendant's production, unpaid contributions, auditor fees, all legal fees and interest, and any other relief as the court deems just. They are represented by Kathryn J. Halford, Elizabeth Rosenfeld and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino.
