Suit filed against Ford over allegedly defective transmission

SACRAMENTO – A Corcoran woman alleges she purchased a vehicle that was defective.

Irma Ruiz filed a complaint on July 21 in the U.S. District Court for the Eastern District of California against Ford Motor Co. and Does 1 through 75 alleging violation of the Song-Beverly Consumer Warranty Act, the Magnuson Moss Warranty Act and the Unfair Competition Law.

According to the complaint, the plaintiff alleges that in July 2014, she purchased a 2012 Ford Focus that is equipped with a Dual PowerShift six-speed (DPS6) transmission. The plaintiff holds Ford Motor Co. and Does 1 through 75 responsible because the defendants allegedly manufactured a defective transmission, which caused jerking and acceleration issues.

The plaintiff requests a trial by jury and seeks award damages to plaintiff, rescission of the purchase contract, incidental and consequential damages, equitable and injunctive relief, interest, all legal fees and any other relief as the court deems just. She is represented by Hallen D. Rosner and Jeffrey L. Le Pere of Rosner, Barry & Babbitt LLP in San Diego.
