SMG Long Term Disability Plan alleged to have wrongfully denied benefits

SACRAMENTO – A doctor alleges he was wrongfully denied disability benefits.

Dr. Fadi G. Haddad filed a complaint on July 22 in the U.S. District Court for the Eastern District of California against SMG Long Term Disability Plan and Hartford Life and Accident Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in March 2015, he became disabled and applied for disability benefits but was denied by the defendants. The plaintiff holds SMG Long Term Disability Plan and Hartford Life and Accident Insurance Co. responsible because the defendants allegedly denied plaintiff's disability benefits despite being disabled within the terms of the plan.

The plaintiff seeks benefits due plus interest at the rate of 10 percent per annum, $220,000 for attorney's fees and any other relief as the court deems just. He is represented by Laurence F. Padway of Law Offices of Laurence F. Padway in Alameda.
