SAN FRANCISCO – The trust funds or a labor union allege an employer did not pay contributions per the terms of a bargaining agreement.
Operating Engineers' Health and Welfare Trust Fund for Northern California; Pension Trust Fund for Operating Engineers' Pensioned Operating Engineers' Health and Welfare Trust Fund; et al. filed a complaint on Aug. 1 in the U.S. District Court for the Northern District of California against Security Paving Co. Inc. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that they suffered damages as the result of unpaid contributions. The plaintiffs hold Security Paving Co. Inc. responsible because the defendant allegedly failed to pay monthly contributions on behalf of its employees in April and June 2015 and March.
The plaintiffs seek any unpaid contributions, liquidated damages on all late paid and unpaid contributions, interest on all late paid and unpaid contributions, all legal fees and any other relief as the court deems just.
