Fabric Selection Inc. claims design was used without permission

LOS ANGELES – Two companies are alleged to have manufactured and distributed garments containing the copyrighted design of a Los Angeles County company without authorization.

Fabric Selection Inc. filed a complaint on Aug. 2 in the U.S. District Court for the Central District of California against New Glory Clothing Inc., Ross Stores Inc. and Does 1 through 10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages as the result of its copyrighted design being reproduced without its consent by the defendants. The plaintiff holds New Glory Clothing Inc., Ross Stores Inc. and Does 1 through 10 responsible because the defendants allegedly licensed, manufactured, sold or offered for sale the purportedly infringing products to customers despite the plaintiff's cease and desist letters.

The plaintiff requests a trial by jury and seeks injunction against the defendants, order to recall and destroy all garments with the infringing design, award plaintiff actual damages and profits derived from the unlawful act, all legal fees and any other relief as the court deems just.
