Altair Instruments files suit against retailers over sale of microdermabrasion devices

LOS ANGELES – A Ventura business has filed a suit against several retailers alleging they distribute microdermabrasion devices that infringes one or more claims of its patent.

Altair Instruments Inc. filed a complaint on Aug. 2 in the U.S. District Court for the Central District of California against Trophy Skin Inc., Ahalife Holdings Inc., QVC Inc., The Neiman Marcus Group LLC, et al. alleging patent infringement.

According to the complaint, the plaintiff alleges that it suffered damages as the result of its '739 patent being incorporated on other devices without its authority. The plaintiff holds the defendants responsible because the defendants allegedly continue to distribute the MicrodermMD, the RejuvadermMD and the MiniMD, which it claims infringes the '739 patent.

The plaintiff requests a trial by jury and seeks injunction against the defendants enjoining and restraining them from further infringing plaintiff's patents, damages plus interest, all legal fees and any other relief as the court deems just. It is represented by Ronald P. Oines, Benjamin C. Deming and Kathryn Domin of Rutan & Tucker LLP in Costa Mesa.
