Oldcastle Precast alleges company is selling utility boxes that infringe patents

SACRAMENTO – The manufacturer of utility boxes used to protect underground components claims a competitor is manufacturing similar boxes unlawfully.

Oldcastle Precast Inc. filed a complaint on Aug. 3 in the U.S. District Court for the Eastern District of California against Jensen Enterprises Inc., doing business as Jensen Precast, alleging patent infringement.

According to the complaint, the plaintiff alleges that in 2012, it suffered damages to its business as the result of the features found on its utility boxes being copied and sold as a different product by the defendants. The plaintiff holds Jensen Enterprises Inc. responsible because the defendant allegedly copied the features of plaintiff's utility boxes an incorporated them into its HN-Series utility boxes.

The plaintiff requests a trial by jury and seeks preliminary and permanent injunction enjoining the defendant from allegedly further infringing plaintiff's patents, award plaintiff damages from patent infringement and trebling those damages, all legal fees and interest and any other relief as the court deems just.
