LOS ANGELES – An inventor has filed a suit over patent infringement claims with the manufacturing of underground infiltration tanks.
Oscar Larach and EcoRain America LLC filed a complaint on Aug. 3 in the U.S. District Court for the Central District of California, Western Division against Delquin Plastics USA Inc., EcoRain Systems Inc., EcoRain Tank Systems of America Inc., Manuel Arriagada, Margarita Arriagada and Does 1 through 100 alleging patent infringement and other counts.
According to the complaint, Larach is the inventor and patent holder of a patent titled Underground Infiltration Tank Module, or patent '436, which he exclusively licensed to EcoRain America LLC. The plaintiffs holds Delquin Plastics USA Inc., EcoRain Systems Inc., EcoRain Tank Systems of America Inc., Manuel Arriagada, Margarita Arriagada and Does 1 through 100 responsible because the defendants allegedly manufactured and sold infiltration tanks that infringes the '436 patent through its design. Larach also alleges that Manuel Arriagada, Margarita Arriagada formerly had partnerships for the purpose of distributing underground infiltration tanks and that they breached fiduciary duty with the plaintiff.
The plaintiffs request a trial by jury and seek preliminary and permanent injunction against the defendants, damages, increased damages of up to three times, compensatory damages, exemplary or punitive damages, all legal fees and any other relief as this court deems just.
