Fashion Nova, Fashion Vitamin accused of using fabric designs without authorization

LOS ANGELES – A Los Angeles owner of copyrighted fabric designs alleges two companies in the state used its designs without permission.

Salt & Pepper Clothing Inc. filed a complaint on Aug. 1 in the U.S. District Court for the Central District of California against Fashion Nova Inc., Fashion Vitamin Inc. and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it was informed that one of its designs for textile printing was copied, reproduced, distributed and sold by the defendants for their own profit, causing plaintiff to suffer substantial damages to its business. The plaintiff holds Fashion Nova Inc. and Does 1-10 responsible because the defendants allegedly copied, reproduced, distributed and sold fabric which featured an unauthorized print design that was identical to plaintiff's design.

The plaintiff requests a trial by jury and seeks profits of defendants, all losses, statutory damages, attorney's fees, interest, costs of suit and such further legal and equitable relief as the court deems proper. It is represented by Frank N. Lee of Law Office of Frank N. Lee in Los Angeles.
