San Diego health company claims CVS-brand glucose monitor infringes patent

LOS ANGELES — A San Diego corporation is suing Agamatrix Inc. over a patent for its glucose monitoring systems used by patients to treat their diabetes.

Dexcom Inc. filed a complaint on Aug. 9 in the U.S. District Court for the Central District of California, Western Division against Agamatrix Inc., alleging that the New Hampshire business distributes products that infringes one or more of the plaintiff's patents. DexCom has more than 700 pending and issued patents worldwide.

According to the complaint, the plaintiff alleges that Dexcom Inc. suffered damages as the result of their patented technology being used without their authority. The plaintiff holds Agamatrix Inc. responsible because the defendant allegedly manufactured a device called CVS Health Advanced Blood Glucose Meter that infringes upon the plaintiff's patents.

The plaintiff requests a trial by jury and seeks award damages sufficient to compensate it, including royalties, interest, all legal fees, an ongoing royalty, all other damages including enhanced damages up to three times the amount of compensatory damages, enjoin the defendant from further infringing the plaintiff's patent, and any other relief as this court deems just. The plaintiff is represented by Erik J. Carlson of Sidley Austin LLP in Los Angeles.
