Taiwanese headphone manufacturer claims patent infringement by eBay dealers

LOS ANGELES — A Taiwanese citizen is suing individual eBay dealers who allegedly are selling headphones that copy his patented design.

Yu, Hsu-Sheng, whose Taiwan-based company Huanson Enterprise Co. manufactures, markets and sells the foam headphones, filed a complaint Aug. 10 in the U.S. District Court for the Northern District of California against John Does (1-19), alleging that the unknown individuals sell headphones that infringe upon the plaintiff's patented design.

According to the complaint, the plaintiff alleges that he has suffered damages as the result of his patented design being used to manufacture other similar products. The plaintiff holds John Does (1-19) responsible because the defendants allegedly sell a similar product containing the plaintiff's patented designed removable pad on eBay.

The plaintiff requests a trial by jury and seeks to permanently enjoin the defendant, be awarded damages adequate to compensate him, all damages, interest, legal fees and any other relief as the court deems satisfactory. He is represented by Garner K. Weng and Janie Lin Thompson of Hanson Bridgett LLP in San Francisco.
