Man claims Credit Financial has called more than 1,000 times

SAN FRANCISCO – An Imperial Beach man alleges that a Las Vegas debt collector has contacted him approximately 1,400 times.

Moises Govea filed a complaint on Aug. 2 in the U.S. District Court for the Southern District of Florida against Credit One Financial alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that between 2014 and the present, he suffered damages as the result of being contacted several times on his cellular telephone. The plaintiff holds Credit One Financial responsible because the defendant allegedly kept on calling plaintiff using an automatic dialing system despite the plaintiff orally revoking his consent and requesting it to stop calling him.

The plaintiff requests a trial by jury and seeks statutory damages for each and every call, injunctive relief against the defendant and any other relief as the court deems just. He is represented by Greg A. Montegna of The Law Offices of Greg Montegna in Chula Vista.
