Woman claims she was harassed by supervisor, terminated for taking medical leave

SACRAMENTO – A Sacramento County woman alleges she was terminated by her employer after taking a medical leave of absence.

Brianna Fizulic filed a complaint on Aug. 11 in the U.S. District Court for the Eastern District of California against Cellco Partnership, a Delaware partnership doing business in the state of California as Verizon Wireless, alleging retaliation.

According to the complaint, the plaintiff was repeatedly sexually harassed by a supervisor after she refused a relationship with him. The suit states the supervisor created a hostile working environment and that she reported his behavior to the defendant's human resources department. In May 2015, a doctor concluded that she should take a leave of absence because the supervisor's actions were causing her panic attacks and extreme anxiety. The plaintiff holds Cellco Partnership responsible because the defendant allegedly allowed plaintiff's supervisor to harass her during her employment and wrongfully terminated her employment in retaliation for going on a medical leave.

The plaintiff requests a trial by jury and seeks past and future economic loss, past and future non-economic loss, damages, punitive damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Robin K. Perkins and Natalia D. Asbill of Perkins & Associates in Sacramento.
