LOS ANGELES — Manufacturers have filed a class-action lawsuit against importer Tri Locus International LLC, claiming the company was selling counterfeit food processors.
Capbran Holdings LLC and Nutribullet LLC filed a complaint Aug. 10 in U.S. District Court for the Central District of California against Tri Locus International LLC, alleging that the importer willfully, deliberately and knowingly imported and offered for sale counterfeit products. The plaintiffs allege copyright infringement and unfair competition.
According to the complaint, the plaintiffs allege that on June 7, they were notified by the U.S. Customs and Border Protection of a seized shipment bearing the marks Magic Bullet and Nutribullet and that the counterfeit food processors were imported by the defendant and exported by Ningbo Yongyi Trading Company. The plaintiff claims their reputation and goodwill have been damaged and they have lost profit. The plaintiffs hold Tri Locus International LLC responsible because the defendant allegedly imported and distributed counterfeit products and deceived buyers with counterfeit retail packaging and booklets, including counterfeit trademarks on the packaging.
The plaintiffs request a trial by jury and seek judgment against the defendant for damages in the amount of at least $1,000,000, statutory damages, lost profits, for the defendant to send notice to consumers who purchased the counterfeit products and the right to a full refund, for the defendant to cease importation and sales, costs of suit, attorney's fees and other relief the court deems appropriate.
