Developer claims former project partner allegedly infringed upon a patent

SAN FRANCISCO — A Delaware corporation has filed suit against a California entity, citing alleged patent infringement regarding software.

Autodesk Inc. filed a complaint on Aug. 17 in  U.S. District Court for the Northern District of California against Joseph Alter and Joseph Alter Inc. alleging that the California corporation accused the plaintiff of patent infringement.

According to the complaint, the plaintiff alleges that Autodes, Inc. suffered damages from being accused of infringing the 962 patent. The plaintiff holds Joseph Alter and Joseph Alter Inc. responsible because the defendant allegedly accused the plaintiff that it has infringed upon the 962 patent, as well as used the XGen software without authorization.

The plaintiff requests a trial by jury and seeks a declaration that the plaintiff has not infringed upon the 962 patent, a declaration that the plaintiff's use of the XGen software is authorized, enjoin the defendant, all legal fees and any other relief as the court deems appropriate. The plaintiff is represented by Jeannine Yoo Sano and Allen Wang of White & Case LLP in Palo Alto and James P. Gagen of White & Case LLP in Washington.
