LOS ANGELES — A garment manufacturer has filed suit against a competitor for alleged copyright infringement over a pattern used on clothing.
Meridian Textiles Inc. filed a complaint on Aug. 12 in U.S. District Court for the Central District of California against Kids Apparel Club Inc. and Does 1-10, alleging that they violated copyright laws.
According to the complaint, the plaintiff alleges that it was informed that the defendant and Does 1 - 10, other parties who have yet to be identified, have infringed or contributed to the infringement of the plaintiff’s copyrights, specifically design L1098 that is registered with the United States Copyright Office. The plaintiff holds Kids Apparel Club Inc. and Does 1-10 responsible because the defendants allegedly have intentionally committed copyright infringement with actual knowledge of the plaintiff’s rights.
The plaintiff requests a trial by jury and seeks that the defendants and their respective agents be enjoined for further copyright infringement, be awarded all profits of defendants, damages, attorneys’ fees, interest, costs of action and further awards as the court deems appropriate.
