DD's Discounts alleged to have sold clothes using copyrighted fabric design

LOS ANGELES – A Los Angeles company alleges a discount store sold clothing using its copyrighted fabric design.

Neman Bros. & Associates Inc. filed a complaint on Aug. 19 in the U.S. District Court for the Central District of California against Ross Stores Inc., doing business as DD's Discounts, and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it suffered damages from having its copyrighted design NB101122-R being used without its consent. The plaintiff holds Ross Stores Inc. and Does 1-10 responsible because the defendants allegedly advertised and distributed clothing bearing plaintiff's design.

The plaintiff requests a trial by jury and seeks to enjoin the defendant from further infringing plaintiff's designs, award plaintiff all profits and losses, statutory damages, all legal fees and interest, and any other relief as the court deems just.
