Pennsylvania business claims CF Industry Sales allegedly didn't deliver enough fertilizer

SACRAMENTO — A Pennsylvania business claims an Illinois corporation breached its contract by allegedly failing to deliver the agreed upon amount of fertilizer. 

International Raw Materials Ltd. filed a complaint on Aug. 19 in U.S. District Court for the Eastern District of California against CF Industry Sales LLC, formerly known as Terra Nitrogen Corp., alleging that the Illinois business breached its contractual agreement with the plaintiff by failing to deliver the agreed volume of UAN.

According to the complaint, the plaintiff alleges that in 2009, International Raw Materials Ltd. suffered damages resulting from several breaches of their contract. The plaintiff holds CF Industry Sales LLC responsible because the defendant allegedly failed to meet the volume requirements of the agreement, as well as refused to remove the remaining UAN from the plaintiff's facility upon the termination of their contract.

The plaintiff requests a trial by jury and seeks all damages, interest, all legal fees and any other relief as the court deems appropriate. It is represented by Steven A. Herum and Dana A.
