SANTA ANA — A patient has filed suit against the manufacturer of a heart implantation device, alleging it was defective and damaged her heart, her kidney and caused other medical issues.
Joan Wiseman filed a complaint on Aug. 22 in U.S. District Court for the Central District of California, Southern Division, against Cook Medical Inc., also known as Cook Medical Inc., Cook Inc. and Cook Group Inc., alleging that they manufacture and sell defective medical devices, one that caused injuries to theplaintiff.
According to the complaint, the plaintiff alleges that in 2015, she suffered injuries from being implanted with a defective Cook Celect® IVC Filter and the fractured arm of the device made its way through the right ventricle of her heart, causing damage to her internal organs. The plaintiff holds Cook Medical Inc. et al responsible because the defendants allegedly failed to disclose to consumers and physicians the possibility of the device breaking.
The plaintiff requests a trial by jury and seeks judgment against the defendant for whatever amount she is entitled plus all legal fees, punitive damages and a jurisdictional amount that exceeds $75,000.
