TV station claims show host, competing station KVLA engaged in unfair business practices

LOS ANGELES — A television station has filed suit against its former show host, along with other parties, for alleged false advertising when the former show host was purportedly spotted selling identical products on a competing television station.

VBS Distribution Inc. and VBS Television Inc. filed a complaint Aug. 23 in U.S. District Court for the Central District of California against Nutrivita Laboratories Inc., Nutrivita Inc., US Doctors’ Clinical Inc., Robinson Pharma Inc., KVLA Inc., Tuong Nguyen, Tram Ho, Jenny Do, also known as Ngoc Nu, and Does 1-10, alleging that they knowingly violated the rights of the plaintiff through unfair business practices.

According to the complaint, the plaintiffs allege that they share the same business concept with the defendants, selling products on their respective shopping networks to Vietnamese audiences in particular. Defendant Ho, while under contract with the plaintiff, allegedly appeared on defendant KVLA's show, promoting an infringing show that was a complete copy of the plaintiffs' show and took from the plantiffs trade secrets, databases and other information to where such acts have purportedly caused significant injury and damage to plaintiffs. 

The plaintiffs holds Nutrivita Laboratories Inc., et al responsible because the defendants allegedly issued false and misleading materials that affected consumers’ purchasing decisions and caused confusion to consumers by suggesting affiliations.

The plaintiffs request a trial by jury and seek judgment against the defendants, to enjoin the defendants from their wrongful acts, damages, interest, attorneys’ fees and other relief that the court deems just. They are represented by William E. Levin of Levin & Dicterow in Laguna Beach.
