American Millwork Co. claimed to owe more than $250,000 in unpaid contributions

LOS ANGELES – A construction industry contractor is alleged to owe more than $250,000 in unpaid employee contributions to several labor funds.

Carpenters Southwest Administrative Corp. and board of trustees for the Carpenters Southwest Trusts filed a complaint on Aug. 24 in the U.S. District Court for the Central District of California, Western Division against First American Millwork Inc., doing business as American Millwork Co., and Does 1-10 alleging that they violated rights of plaintiffs under the Labor-Management Relations Act and Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that that the memorandum agreements between the employers and unions that bind the defendants to pay fringe benefit contributions for every hour worked by their employees were not followed, as employer/defendants were delinquent with their obligations. 

The plaintiffs hold First American Millwork Inc. and Does 1-10 responsible because the defendants allegedly failed to report and pay all contributions owed and failed to pay contributions when due.

The plaintiffs request a trial by jury and seek contributions in the sum of $254,440.43, interest, liquidated damages, audit costs, attorney's fees, costs of this action and further relief as the court deems proper. They are represented by Jodi Siegner of DeCarlo & Shanley in Los Angeles.
