MD Collections accused of sending collection letters that violate debt laws

SANTA ANA – An Orange County consumer alleges a debt collector violated federal and state laws regarding debt collection with letters it sent her.

Briana Guerrero filed a complaint on Aug. 27 in the U.S. District Court for the Central District of California, Southern Division against MD Collections Inc. alleging violation of the Rosenthal Fair Debt Collection Practices Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in 2015, the defendant sent her two letters in an attempt to collect an alleged debt. However, the suit states that the letters did not disclose the name of the creditor of the alleged debt and the first letter did not state its purpose was to collect a debt, which are purported violations of the RFDCPA and the FDCPA.

The plaintiff holds MD Collections Inc. responsible because the defendant's alleged violations of the RFDCPA and the FDCPA caused her personal humiliation, embarrassment, emotional distress and mental anguish.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages of $1,000, all legal fees and any other relief as the court deems just. She is represented by Michael Jones of M. Jones and Associates PC in Santa Ana.
