Golden State Warriors app alleged to record users' conversations without consent

SAN FRANCISCO – A New York woman alleges an NBA team's mobile app invades users' privacy by recording conversations without consent and has filed a class-action suit.

Latisha Satchell filed a complaint on behalf of all others similarly situated on Aug. 29 in the U.S. District Court for the Northern District of California against Sonic Notify Inc., doing business as Signal360; Yinzcam Inc.; and Golden State Warriors LLC alleging violation of the Electronic Communications Privacy Act.

According to the complaint, the plaintiff alleges the Golden State Warriors mobile application "listens" to users' conversations when running. The suit states the Yinzcam-developed app listens for Singal360 audio beacons using a smartphone's microphone for terms needed to display advertising.

The plaintiff holds Sonic Notify Inc., Yinzcam Inc. and Golden State Warriors LLC responsible because the defendants allegedly failed to disclose or inform consumers that their smartphones are being turned into listening devices and did not seek consent.

The plaintiff requests a trial by jury and seeks statutory damages plus any profits made by the defendant derived from the allegedly unlawful act, $100 per class member per day of defendant's violations or $10,000 per class member, punitive damages, injunctive relief, all legal fees and interest plus any other relief the court grants. She is represented by Stewart R. Pollock of Edelson PC in San Francisco.
