Patents 09

SAN DIEGO — A manufacturer claims a competitor allegedly infringed its patent for a part it produces.

Turn-Key-Tech LLC filed a complaint on Aug. 24 in U.S. District Court for the Southern District of California against Clarblanc LLC and Does 1-100, alleging that it violated the rights of the plaintiff under the patent laws.

According to the complaint, the plaintiff alleges that Turn-Key-Tech LLC was made aware that its patent '316 entitled "Injection-Molded Plastic Container" was infringed by the defendants who were purportedly producing and selling products that use parts with similar to the '316 patented process.

The plaintiff holds Clarblanc LLC and Does 1-100 responsible because the defendants allegedly made, used, imported and sold the accused products without consent or authority from the plaintiff and gained profit from their reported efforts.

The plaintiff requests a trial by jury and seeks judgment against the defendants, account for damages, attorney's fees, interest, costs of suit and further relief as the court may deem just. It is represented by Christian Fenton of The Law Office of Christian Fenton in San Diego.
