Copyright 04

LOS ANGELES – A Los Angeles company alleges three clothing manufacturers used its textile design in garments without permission.

Unicolors Inc. filed a complaint on Sept. 6 in the U.S. District Court for the Central District of California against Rainbow USA Inc., Beall's Inc., Apollo Apparel Group and Does 1-10 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it has not authorized anyone to make sales of products bearing plaintiff’s proprietary designs without express permission. The plaintiff holds Rainbow USA Inc., Beall's Inc., Apollo Apparel Group and Does 1-10 responsible because the defendants allegedly purchased, sold, advertised, marketed, manufactured, imported and/or distributed fabrics and/or garments with the same or similar design of the plaintiff's designs without consent.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages, attorneys’ fees, interest, costs of litigation and further relief as the court deems proper. It is represented by C. Yong Jeong and Jesse Yanco of Jeong & Likens LC in Los Angeles.
