Life Insurance Co. allegedly wrongly denied man long-term disability payments

SAN DIEGO — A man has filed suit against a life insurance company for allegedly refusing to pay him long-term disability benefits.

Saidal Homman filed a complaint Sept. 6 in U.S. District Court for the Southern District of California against Life Insurance Co. of North America, alleging that the claims administrator violated his rights under ERISA by refusing to pay his long-term disability benefits.

According to the complaint, the plaintiff alleges that he was covered under a group disability policy that was issued by the defendant to the plaintiff's former employer, Veritiss LLC. However, the plaintiff became disabled under the terms of the plan and supposedly submitted a claim to the defendant for payment of disability benefits in a timely manner. On June 30, 2014, the defendant denied his disability claim. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to consider the opinions of the plaintiff's treating physicians, failed to promptly identify the medical consultants who reviewed the plaintiff's file and failed to timely advise the plaintiff of documentation needed to complete his claim.

The plaintiff requests a trial by jury and seeks judgment against defendant, benefits, interest, attorney's fees and further relief as the court deems just. He is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario.
