Audio-visual company claims Office Design Group et al allegedly owe more than $290,000

SAN DIEGO — A subcontractor has filed suit against its clients for allegedly failing to pay for completed projects per their contracts.

Anderson Audio Visual - San Diego Inc. filed a complaint Sept. 7 in U.S. District Court for the Southern District of California against Office Design Group, NEI Contracting and Engineering Inc., Philadelphia Indemnity Insurance Co., Suretec Indemnity Co. and Does 1-50,   alleging that they violated the prompt payment statute.

According to the complaint, the plaintiff alleges that on April 15, Anderson Audio Visual - San Diego Inc. completed its work as a subcontractor on a project at the Camp Pendleton Building. Per the contract with the defendants as general contractors, the plaintiff purportedly agreed to provide labor, materials, installation, supplies and equipment of high-tech audio-video systems. The plaintiff supposedly delivered all contracted work, but there remains a balance on the account in the amount of $290,237.21 plus interest. 

The plaintiff holds Office Design Group, NEI Contracting and Engineering Inc., Philadelphia Indemnity Insurance Co., Suretec Indemnity Co. and Does 1-50 responsible because the defendants allegedly failed to timely pay the plaintiff the amount due and failed to execute its part in the contract.

The plaintiff requests a trial by jury and seeks judgment in its favor, damages in excess of $290,237.21, penalties in an amount of $17,414.23, interest, attorney's fees, costs of suit and further relief as the court may deem appropriate.
