Fantasy Jewels alleged to have sold counterfeit Cartier jewelry

SAN FRANCISCO – A jewelry store in San Rafael's Northgate Mall is accused of selling counterfeit Cartier products.

Cartier International AG and Cartier, a division of Richemont North America Inc., filed a complaint on Sept. 15 in the U.S. District Court for the Northern District of California against Fantasy Jewels, Massoud Torabian and Does 1-10 alleging trademark counterfeiting and infringement.

According to the complaint, the plaintiffs allege that the defendants have manufactured, advertised, offered for sale, sold, distributed, imported, and/or exported counterfeit and/or infringing jewelries under the Cartier marks and/or bearing substantially identical marks and style. The plaintiffs allege their agent visited defendants' store several times to confirm information and to deliver a cease and desist letter, but that the defendants have refused to surrender the infringing products.

The plaintiffs hold Fantasy Jewels, Massoud Torabian and Does 1-10 responsible because the defendants allegedly caused confusion as to an affiliation to the plaintiffs and distributed counterfeit items.

The plaintiffs request a trial by jury and seek judgment in their favor; injunction from further infringement; turn over infringing materials for destruction; grant plaintiffs the gains, profits, savings, and advantages from infringement; damages; costs; attorneys' fees; interest and further relief as the court may deem just.
