Former teacher alleges she is still disabled, wrongfully terminated from receiving benefits

LOS ANGELES – A former preschool teacher alleges she was wrongfully terminated from receiving disability benefits.

Janet Weisz filed a complaint on Sept. 14 in the U.S. District Court for the Central District of California against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in February 2012, she became disabled and was initially being paid disability benefits until it was terminated on February 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny further payment of plaintiff's disability benefits despite still being disabled according to the terms of the plan.

The plaintiff seeks benefits not paid to plaintiff plus interest, order that plaintiff is eligible for future disability benefits, all legal fees and any other relief as the court deems just. She is represented by Frank N. Darras, Lissa A. Martinez, Susan B. Grabarsky and Phillip S. Bather of DarrasLaw in Ontario.
