NF Films accused of underpaying employee contributions to labor union groups

LOS ANGELES – A film production company is alleged to have not paid in full the contributions owed on behalf of its employees.

Board of directors of the Motion Picture Industry Pension Plan, board of directors of the Motion Picture Industry Individual Account Plan; board of directors of the Motion Picture Industry Health Plan filed a complaint on Sept. 15 in the U.S. District Court for the Central District of California, Western Division against NF Films LLC citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they audited the defendant's records and discovered it underpaid the plaintiffs in the amount of $2,823,60. The plaintiffs allege they incurred expenses of $2,115 for the audit.

The plaintiffs hold NF Films LLC responsible because the defendant allegedly breached their bargaining agreement with plaintiff when they failed to pay its benefit contributions on behalf of its employees.

The plaintiffs seek unpaid contributions in the sum of $2,823.60, interest at the rate of 1 percent per month, liquidated damages presumed to be the greater of 20 percent of the contributions due plus interest at 1 percent per month, audit costs, all legal fees and any other relief as the court deems just. They are represented by Kathryn J. Halford, Elizabeth Rosenfeld and Nicholas I. Starkman of Wohlner Kaplon Cutler Halford & Rosenfeld in Encino.
