LOS ANGELES – The makers of UGG boots allege two New York companies have copied its particular design of boots.
Deckers Outdoor Corp. filed a complaint on Sept. 14 in the U.S. District Court for the Central District of California against Gina Group LLC; E.B.H. 5 Inc., doing business as Shoes8teen; and Does 1-10 alleging trade dress infringement and unfair competition.
According to the complaint, the plaintiff alleges that it suffered damages to its business as the result of its trademark design for Bailey Button Boot being used without its permission. The plaintiff holds Gina Group LLC; E.B.H. 5 Inc., doing business as Shoes8teen; and Does 1-10 responsible because the defendants allegedly copied the boot design for its own Chatz brand boots.
The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's trade dress, order the defendant to recall all infringing products for destruction, award plaintiff all profits and damages, compensatory damages, treble damages, punitive damages, all legal fees and any other relief as the court deems just.
