LOS ANGELES – A Washington retailer is accused of selling garments with a Vernon corporation's copyrighted fabric design without permission.
Unicolors Inc. filed a complaint on Sept. 14 in the U.S. District Court for the Central District of California against Zulily LLC and Does 1-10 citing copyright infringement.
According to the complaint, the plaintiff alleges that it suffered damages from having its copyrighted EH101 design used on other fabrics without its permission. The plaintiff holds Zulily LLC and Does 1-10 responsible because the defendants allegedly sold fabrics and/or clothing with a confusingly similar design as plaintiffs using online and retail stores.
The plaintiff requests a trial by jury and seeks enjoin the defendant, all profits, statutory damages, all legal fees and interest plus any other relief as the court deems just. It is represented by C. Yong Jeong of Jeong & Likens LC in Los Angeles.
