Standard Fabrics International Inc. accuses Rue 21 of copyright infringement

LOS ANGELES – The owner of the copyright for a fabric design alleges a retailer copied it for a garment without authorization.

Standard Fabrics International Inc. filed a complaint on Sept. 19 in the U.S. District Court for the Central District of California against Rue21 Inc. and Does 1-10 alleging copyright violation.

According to the complaint, the plaintiff alleges that its two-dimensional artwork tagged as design number 9126 was copied by the defendants with every intention to manufacture, market, sell and gain profit from the subject design. It alleges that as a result of defendant's acts, it has suffered substantial damages to its business. 

The plaintiff holds Rue21 Inc. and Does 1-10 responsible because the defendants allegedly committed intentional acts of infringement and obtained profit at the expense of plaintiff's intellectual property.

The plaintiff requests a trial by jury and seeks judgment in its favor, enjoin defendants from further infringement, damages, attorneys' fees, interest, costs of action and further relief as deemed just. It is represented by Stephen M. Doniger, Scott A. Burroughs, Trevor W. Barrett and Justin M. Gomes of Doniger/Burroughs in Venice.
