The Tech Brothers allegedly infringed upon Adobe's trademark

SAN FRANCISCO — A major software developer has filed suit against an individual and his company for alleged trademark infringement and false advertising.

Adobe Systems Inc. filed a complaint Sept. 1 in U.S. District Court for the Northern District of California against Ronny Cohen, doing business as The Tech Brothers, and Does 1-10,   alleging that they violated the Lanham Act through illegal distribution.

According to the complaint, the plaintiff alleges that  Adobe Systems Inc.'s investigator had purchased a purported “Adobe Acrobat Professional XI Windows Download Delivery” from the defendants’ website and several times thereafter to confirm the unauthorized selling and counterfeit reproductions of the plaintiff's trademarks. 

The plaintiff holds Ronny Cohen, doing business as The Tech Brothers, and Does 1-10 responsible because the defendants allegedly confused consumers as to the true source and affiliation of the infringing products, gained profit at the expense of plaintiff and diluted/diminished the trademarks and goodwill of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant, an awardnig of the defendants’ profits and plaintiff’s damages, constructive trust, destruction of the infringing articles, attorney’s fees, costs of suit and further relief as the court may deem just.
